In a bold stand against judicial overreach, Republican Rep. Randy Fine (R-FL) has introduced an impeachment resolution targeting Judge Charles Breyer of California’s Northern District, after the judge attempted to block President Trump’s lawful order to send the National Guard into Los Angeles to quell violent anti-ICE riots.
The controversy erupted after riots erupted in Los Angeles on June 6, 2025, targeting Immigration and Customs Enforcement agents amid lawlessness that threatened public safety. President Trump, acting decisively to restore order, authorized the deployment of National Guard units. But Judge Breyer, rather than supporting the restoration of law and order, claimed the President’s actions violated both statutory authority and the Constitution’s Tenth Amendment.
According to court filings, Judge Breyer argued that President Trump failed to follow “congressionally mandated procedure” and insisted the National Guard should be under the control of California’s governor — a Democrat governor known for lax enforcement and enabling the city’s lawlessness. Breyer went so far as to say the protests did not amount to “rebellion,” seemingly dismissing the severity of the situation.
Breyer’s attempt to intervene “at this early stage” was quickly blocked by higher courts, but not before igniting fierce criticism from conservatives nationwide.
Rep. Randy Fine responded swiftly, filing an impeachment resolution that accuses the judge of “high crimes and misdemeanors” — a charge reserved for serious breaches of trust. Fine condemned Breyer’s actions as “knowingly and willfully” using his judicial power to serve a political agenda rather than uphold the Constitution and public safety.
“The judge abused his authority and violated his oath to impartially uphold the law,” Fine declared. “By interfering with the President’s constitutional prerogative to enforce federal law, Breyer placed politics over the people he swore to serve.”
Fine emphasized that impeachment is the constitutional remedy for federal officials, including judges, who step outside their bounds. “All civil officers, including federal judges, are accountable under the Constitution,” he said. “If judges think they are above the law, then our system of checks and balances breaks down.”
While acknowledging that removal from office might be unlikely, Fine insisted the impeachment resolution is vital to send a message: judges must do their jobs without political bias or obstruction.
“The goal is to hold judges accountable and ensure they stop abusing their power,” Fine explained. “If we don’t act, judges will continue to undermine law enforcement and the rule of law.”
This case highlights a growing trend of activist judges attempting to thwart President Trump’s efforts to secure the border and uphold immigration laws. Instead of supporting federal efforts to combat lawlessness and protect communities, some members of the judiciary have chosen to put politics ahead of justice.
