According to the Treasury Department statement, the agency is issuing new regulations clarifying that the refundable portions of major credits — including the Earned Income Tax Credit (EITC), the Additional Child Tax Credit, the American Opportunity Tax Credit, and the Saver’s Match Credit — constitute “federal public benefits” under the 1996 welfare reform law known as PRWORA.
That designation carries huge consequences.
Under federal law, illegal immigrants and other “non-qualified aliens” are barred from receiving federal public benefits. Treasury’s clarification means that starting with tax year 2026, they will no longer be able to exploit refundable credits to walk away with thousands in taxpayer cash.
