The young girl tragically died from an allergic reaction after consuming pizza at her school, Lorenzo de Zavala Middle School, in January last year. Emerson, who had a known severe dairy allergy, had a detailed 504 plan with the Amarillo Independent School District. This plan clearly outlined the necessary steps school staff should take in the event of an allergic reaction, including the immediate administration of epinephrine, calling 911, and notifying Emerson’s parents. Yet, the family claims these protocols were not followed.

On the day of the incident, Emerson consumed pizza at school and soon experienced a severe allergic reaction. When she was sent to the nurse’s office, the nurse was reportedly not present. Instead of following the emergency plan, school staff contacted Emerson’s mother to ask permission to give her Benadryl, which Emerson then vomited. The situation rapidly deteriorated, and by the time Emerson’s grandmother arrived, the young girl had collapsed. Despite her grandmother’s desperate attempts to revive her with CPR, Emerson was pronounced dead days later at the hospital.

The lawsuit, filed by Emerson’s grieving family, underscores a critical failure on the part of the school to act swiftly and in accordance with the established medical plan. Dr. Marc Serota, an expert cited in the lawsuit, stated that the prompt administration of epinephrine would likely have saved Emerson’s life. “Had she received prompt administration of epinephrine when she initially presented with her symptoms, (Cole) would, more likely than not, be with us today,” Dr. Serota affirmed.

The family’s pain is immeasurable. Emerson’s father poignantly expressed his sorrow and love for his daughter on Facebook, writing, “There is nothing anyone can say or do to make this hurt and pain go away… Emerson Kate Cole, I’ll NEVER STOP LOVING YOU.”
