In a stunning legal move that underscores just how desperate the Deep State has become, disgraced former FBI Director James Comey is now begging a federal judge to toss out the Department of Justice’s criminal case against him — claiming that his prosecution is “vindictive” and politically motivated by President Trump.

Comey, 64, faces serious federal charges of lying to Congress and obstruction of justice — charges that stem from his role in the FBI’s infamous Trump-Russia hoax, one of the biggest political scandals in modern history. Despite overwhelming evidence of misconduct, Comey insists he’s a victim of “personal animus” from Trump and is demanding the charges be dropped.

In his motion to dismiss, Comey’s lawyers argued that the government “singled out Mr. Comey for prosecution because of his protected speech” and because of President Trump’s “personal spite.” The filing even claims that Trump “ordered” the DOJ to go after Comey “because Mr. Comey has frequently criticized the President.”

Comey’s legal team pointed to a September 20 post on Trump’s Truth Social account, in which the President urged Attorney General Pam Bondi to “deliver justice” against corrupt officials who abused their power — including Comey, former New York AG Letitia James, and Rep. Adam Schiff (D-CA).

Just two days later, U.S. Attorney Lindsey Halligan was sworn in to replace former U.S. Attorney Erik Siebert in the Eastern District of Virginia — and shortly thereafter, Comey was indicted. His lawyers allege that Halligan’s appointment was “unlawful” and that Trump’s DOJ “rushed” to charge him.

The filing even included 60 pages of Trump’s past criticisms of Comey, including when Trump called him a “proven LEAKER & LIAR” and a “weak and untruthful slimeball.” Comey’s team claimed those comments show “genuine animus” toward their client. But critics say the comments were well-deserved — given that Comey’s own deputy, Andrew McCabe, admitted the FBI had leaked information to the media at Comey’s direction.

The charges against Comey stem from his 2020 testimony before the Senate Judiciary Committee, when he denied authorizing those leaks. Republicans say that testimony was a blatant lie — and now, the former FBI chief is finally being held accountable.

If convicted, Comey faces up to five years in prison for making false statements and obstructing justice. But instead of accepting responsibility, he’s trying to wriggle free on technicalities — including a bizarre claim that Halligan’s appointment was invalid because the Attorney General, not a panel of judges, named her as interim U.S. attorney.
