Jonathan Hafetz, a liberal law professor, claimed that “there would be a number of litigations” against Trump’s plan, suggesting that activist judges might try to interfere. But even he admitted that today’s Supreme Court might not be as willing to entertain these frivolous legal challenges as courts did in the past.
