Last year, a Casper, Wyoming police officer was shot during a gun battle with suspects and subsequently succumbed to his injuries. Another policeman fired at the suspect after he was wounded in the encounter with the Wyoming cops. On Monday, attorneys for the guy who shot the Casper cop are suing the city of Casper and its police department as well as officers for $500,000 in damages and other compensation. The lawyers demand punishment for the offender because he was injured while fighting with Wyoming law enforcement officers in the complaint filed in federal court.

The Wyoming attorney said: “Defendants Officer (Jacob) Carlson and Officer (Randi) Garrett’s unlawful and unwarranted acts, lack of training, and deviation from official customs or policies of law enforcement agencies at large, unlawfully caused David Wolosin’s injuries and death.”

The lawsuit filed by David Wolosin’s lawyers argues that he had the right to carry and use a firearm in self-defense per the second amendment. The complaint also alleges that police violated his constitutional rights by conducting unwarranted searches, seizures, and denying him due process. Wolosin is seeking financial compensation for the damages he incurred as a result of the suspected police misconduct.

Many people are incensed that a defendant who harmed a police officer would be sued on his behalf. In Wyoming’s Casper City Attorney John Henley expressed his shock and disappointment that this was taking place in his home state.

On May 22, 2018, an incident occurred in which David Wolosin was accused of allowing minors to drive a moving car. Someone called the cops to report that David Wolosin was allowing young people to operate a vehicle. The caller claimed that a youngster was driving around an empty parking lot in a sedan with another youngster inside. Both of the boys were nephews of David.

Officer Jacob Carlson arrived as a backup for Officer Randi Garrett, who had been on the scene first. When Carlson arrived, he left his patrol car to approach Wolosin’s vehicle where Officer Garrett was already speaking with him. Footage supplied from the Casper Police Department shows David using a cell phone while trying to back away from the nearby cop.

According to the complaint, David allegedly said, “Please give me some space. Please back up, please.”

The footage depicts Officer Carlson being shoved by David after which he retaliated by shooting at Carlson. As a result, the officer was injured and fell to the ground.

Officer Garrett took his side piece off and engaged in a firefight with David after he opened fire. The cops hide behind the vehicle as the youngsters are still within shooting range.

The investigation resulted in a determination that Officer Garrett killed David Wolosin.

Officer Carlson (pictured) spent a month recovering at the Wyoming Medical Center after the shootout. During his time at the facility, he had a heart attack during surgery and has since retired from the force.

After an investigation, it was discovered that both Carlson and Garrett were innocent in the death of Wolosin. The family members of Wolosin are now asking for $500,000 due to the emotional pain they experienced after his death.
