In a legal battle that’s heating up faster than a pot of boiling water, Kraft Heinz, the maker of America’s beloved Kraft Mac & Cheese, has been ordered to face a proposed nationwide class-action lawsuit. The claim? Misleading consumers by boasting “No Artificial Preservatives” on the box, despite allegations to the contrary.

The lawsuit, led by consumers from Illinois, California, and New York, accuses Kraft Heinz of including synthetic citric acid and sodium phosphates in its Mac & Cheese, ingredients they argue function as preservatives. If true, this would make the “No Artificial Flavors, Preservatives or Dyes” label a false promise.

U.S. District Judge Mary Rowland, based in Chicago, found the allegations sufficient to move forward. The plaintiffs cited academic studies and FDA guidance to support their claim that Kraft’s ingredients are anything but natural.

“These allegations are enough to withstand a motion to dismiss,” Judge Rowland stated.

Kraft Heinz pushed back, arguing there’s no proof the ingredients function as artificial preservatives or that reasonable consumers would interpret them as such. Calling its Mac & Cheese “iconic,” the company dismissed the claims as baseless.

For now, the judge agreed with Kraft Heinz on one point: the plaintiffs lack standing to demand new labels, as they are now aware of the alleged deception and face no risk of being misled in the future. However, the case remains alive, leaving Kraft Heinz on the hook for potential damages.

The company, headquartered in Chicago and Pittsburgh, has yet to comment on the latest legal developments.
